利用規約

Article 1 (Service)

The Service provides a place where people can explore and view websites represented as stars. Eligible users may submit and share information about websites that they have created or currently operate.

Article 2 (Accounts)

1. Some features, including website submission, require registration and sign-in through the method specified by the Service.
2. Users must keep their registration information accurate and current and are responsible for appropriately managing their sign-in credentials.
3. The operator is not liable for loss caused by inadequate credential management or unauthorized use by a third party, except where the operator acted intentionally or negligently.
4. Minors should obtain the consent of a parent or other legal representative where required before using the Service.

Article 3 (Submissions, Review, and Licence)

1. Users may submit only websites that they created or operate, or for which they possess the rights and permissions necessary for listing.
2. Submissions enter a pending-review state and may be checked through automated measures and, where necessary, operator review before publication. Published names, URLs, descriptions, categories, icons, and related information will be visible to other users.
3. Users grant the operator a non-exclusive, royalty-free licence to use submitted information only as reasonably necessary to provide, review, display, search, translate, introduce, maintain, and improve the Service. This licence does not transfer ownership of the submitted information to the operator.
4. The Service may apply URL validation, duplicate detection, submission limits, pending-review limits, and other measures intended to prevent misuse.
5. The operator may reject, request correction of, suspend, or remove a submission when it violates these Terms, does not fit the purpose of the Service, or raises safety concerns.
6. When the operator independently selects a website for listing, it will first confirm the relevant rights and whether the listing is permitted.

Article 4 (Prohibited Conduct)

Users must not:

1. Submit phishing, malware-distribution, fraudulent, spam, or other dangerous or unlawful websites;
2. Submit websites containing illegal or adult content, discrimination, threats, harassment, or material likely to cause serious harm to others;
3. Impersonate another person or submit a website as their own without authority;
4. Infringe copyrights, trademarks, privacy rights, or other rights of a third party;
5. Disrupt the Service, its servers, or networks, impose an unreasonable load, or attempt unauthorized access;
6. Attempt to bypass submission limits, review, or safety measures; or
7. Engage in conduct that the operator reasonably determines to be inappropriate.

Article 5 (Safety Checks and External Websites)

1. The Service contains links to external websites listed by the operator or users.
2. The Service may use URL validation, duplicate detection, review, reporting, and other safety measures, but does not guarantee that every dangerous website will be detected or blocked.
3. The operator of each external website is responsible for its content, safety, accuracy, legality, and availability. AloftPort does not guarantee these matters.
4. Users should check the destination URL and displayed information and access external websites using their own judgment and responsibility.

Article 6 (Action on Accounts and Submissions)

Where a user violates these Terms, misuse is suspected, or a safety issue arises, the operator may investigate and take reasonably necessary action, including unpublishing or removing a submission, restricting features, or suspending an account.

Article 7 (Changes, Suspension, and Termination)

The operator may change, suspend, or terminate all or part of the Service for maintenance, incident response, security, interruption of an external service, legal compliance, or other necessity. Where practicable, important changes or termination will be announced on the Service in advance.

Article 8 (Intellectual Property)

Rights in the Service’s interface, logo, design, text, and programs belong to the operator or their legitimate owners. Rights in information submitted by users remain with the user or the original rights holder.

Article 9 (Disclaimer and Limitation of Liability)

1. The operator does not warrant that the Service will be free from defects, interruption, data loss, security vulnerabilities, or infringement of rights.
2. The operator is not liable for loss arising from use of, or inability to use, the Service, except where the operator acted intentionally or negligently.
3. Even where the operator is liable, liability for loss caused by ordinary negligence is limited to ordinary and direct loss, except where such a limitation is not permitted under the Consumer Contract Act or other applicable law.
4. Disputes between users and external website operators or other third parties are to be resolved between those parties, unless applicable law establishes responsibility on the part of the operator.

Article 10 (Changes to These Terms)

1. The operator may change these Terms as necessary in accordance with applicable law.
2. Changes that materially affect users will be announced on the Service, together with their effective date, before taking effect. Minor changes take effect when posted.

Article 11 (Governing Law and Jurisdiction)

1. These Terms are governed by the laws of Japan.
2. Unless otherwise required by law, the Japanese court having jurisdiction over the operator’s address will have exclusive jurisdiction in the first instance over disputes relating to the Service.

El Servicio ofrece un espacio donde las personas pueden explorar y visitar sitios web representados como estrellas. Los usuarios que cumplan los requisitos pueden enviar y compartir información sobre sitios web que hayan creado o administren actualmente.

Artículo 2 (Cuentas)

1. Algunas funciones, incluido el envío de sitios web, requieren registrarse e iniciar sesión mediante el método indicado por el Servicio.
2. Los usuarios deben mantener sus datos de registro actualizados y son responsables de gestionar correctamente sus credenciales de acceso.
3. El operador no será responsable de las pérdidas causadas por una gestión inadecuada de las credenciales o por el uso no autorizado por terceros, salvo que haya actuado de forma intencionada o negligente.
4. Los menores deberán obtener el consentimiento de un progenitor u otro representante legal cuando sea necesario antes de utilizar el Servicio.

Artículo 3 (Envíos, revisión y licencia)

1. Los usuarios solo pueden enviar sitios web que hayan creado o administren, o para los que posean los derechos y permisos necesarios para su publicación.
2. Los envíos quedan pendientes de revisión y, antes de publicarse, pueden someterse a comprobaciones automáticas y, cuando sea necesario, a revisión por parte del operador. Los nombres, URL, descripciones, categorías, iconos e información relacionada que se publiquen serán visibles para otros usuarios.
3. Los usuarios conceden al operador una licencia no exclusiva y gratuita para utilizar la información enviada únicamente en la medida razonablemente necesaria para prestar, revisar, mostrar, buscar, traducir, presentar, mantener y mejorar el Servicio. Esta licencia no transfiere al operador la propiedad de la información enviada.
4. El Servicio puede aplicar validación de URL, detección de duplicados, límites de envíos y de revisiones pendientes, y otras medidas destinadas a evitar usos indebidos.
5. El operador puede rechazar, solicitar la corrección, suspender o eliminar un envío si incumple estos Términos, no se ajusta al propósito del Servicio o plantea problemas de seguridad.
6. Cuando el operador seleccione un sitio web por iniciativa propia, comprobará previamente los derechos pertinentes y si su publicación está permitida.

Artículo 4 (Conductas prohibidas)

Los usuarios no deben:

1. Enviar sitios de phishing, distribución de malware, fraude, spam u otros sitios peligrosos o ilegales;
2. Enviar sitios con contenido ilegal o para adultos, discriminación, amenazas, acoso o material que pueda causar daños graves a otras personas;
3. Suplantar a otra persona o presentar como propio un sitio sin autorización;
4. Infringir derechos de autor, marcas, privacidad u otros derechos de terceros;
5. Interferir en el Servicio, sus servidores o redes, imponer una carga excesiva o intentar acceder sin autorización;
6. Intentar eludir los límites de envío, la revisión o las medidas de seguridad; o
7. Realizar conductas que el operador considere razonablemente inapropiadas.

Artículo 5 (Comprobaciones de seguridad y sitios externos)

1. El Servicio contiene enlaces a sitios web externos publicados por el operador o por los usuarios.
2. El Servicio puede utilizar validación de URL, detección de duplicados, revisión, informes y otras medidas de seguridad, pero no garantiza que todos los sitios peligrosos sean detectados o bloqueados.
3. El responsable de cada sitio externo responde de su contenido, seguridad, exactitud, legalidad y disponibilidad. AloftPort no garantiza estos aspectos.
4. Los usuarios deben comprobar la URL de destino y la información mostrada y acceder a los sitios externos bajo su propio criterio y responsabilidad.

Artículo 6 (Medidas sobre cuentas y envíos)

Cuando un usuario incumpla estos Términos, se sospeche un uso indebido o surja un problema de seguridad, el operador podrá investigar y adoptar las medidas razonablemente necesarias, como retirar o eliminar un envío, limitar funciones o suspender una cuenta.

Artículo 7 (Cambios, suspensión y finalización)

El operador puede modificar, suspender o finalizar total o parcialmente el Servicio por mantenimiento, respuesta a incidentes, seguridad, interrupción de un servicio externo, cumplimiento legal u otra necesidad. Cuando sea posible, los cambios importantes o la finalización se anunciarán previamente en el Servicio.

Artículo 8 (Propiedad intelectual)

Los derechos sobre la interfaz, el logotipo, el diseño, los textos y los programas del Servicio pertenecen al operador o a sus titulares legítimos. Los derechos sobre la información enviada por los usuarios permanecen en el usuario o en el titular original.

Artículo 9 (Exclusión y limitación de responsabilidad)

1. El operador no garantiza que el Servicio esté libre de defectos, interrupciones, pérdida de datos, vulnerabilidades de seguridad o infracciones de derechos.
2. El operador no será responsable de las pérdidas derivadas del uso o de la imposibilidad de usar el Servicio, salvo que haya actuado de forma intencionada o negligente.
3. Incluso cuando el operador sea responsable, la responsabilidad por pérdidas causadas por negligencia ordinaria se limitará a los daños ordinarios y directos, salvo que dicha limitación no esté permitida por la Ley de Contratos de Consumo u otra legislación aplicable.
4. Las disputas entre usuarios y operadores de sitios externos u otros terceros deberán resolverse entre dichas partes, salvo que la legislación aplicable establezca la responsabilidad del operador.

Artículo 10 (Cambios en estos Términos)

1. El operador puede modificar estos Términos cuando sea necesario y de conformidad con la legislación aplicable.
2. Los cambios que afecten de manera importante a los usuarios se anunciarán en el Servicio, junto con su fecha de entrada en vigor, antes de que surtan efecto. Los cambios menores entrarán en vigor cuando se publiquen.

Artículo 11 (Ley aplicable y jurisdicción)

1. Estos Términos se rigen por las leyes de Japón.
2. Salvo que la ley disponga otra cosa, el tribunal japonés competente en el domicilio del operador tendrá jurisdicción exclusiva en primera instancia sobre las disputas relacionadas con el Servicio.

第1条（サービスの内容）

当サービスは、Webサイトを星として探索・閲覧できる場を提供し、所定の条件を満たす利用者が、自身で制作または運営するWebサイトの情報を投稿して共有できるサイトギャラリーです。

第2条（アカウント）

1. 当サービスの一部の機能（Webサイトの投稿等）を利用するには、当サービス所定の方法によるアカウント登録およびログインが必要です。
2. 利用者は、登録情報を正確かつ最新の状態に保ち、ログイン情報を自己の責任で適切に管理するものとします。
3. ログイン情報の管理不備または第三者による不正使用によって生じた損害について、運営者に故意または過失がある場合を除き、運営者は責任を負いません。
4. 未成年者は、必要に応じて保護者等の法定代理人の同意を得たうえで当サービスを利用してください。

第3条（投稿、審査および掲載許諾）

1. 利用者は、自身で制作または運営しているWebサイト、または掲載に必要な権利・許諾を有するWebサイトの情報に限り投稿できます。
2. 投稿された内容は審査待ちとなり、公開前に自動的な確認を行い、必要に応じて運営者が確認します。公開されたサイト名、URL、説明文、カテゴリー、アイコン等は、当サービス上で他の利用者に表示されます。
3. 利用者は運営者に対し、投稿した情報を当サービスの提供、審査、表示、検索、翻訳、紹介、保守および改善に必要な範囲で、無償かつ非独占的に利用することを許諾します。この許諾は、投稿情報の権利を運営者へ移転するものではありません。
4. 当サービスには、URL形式の確認、重複確認、投稿数制限、審査待ち件数の制限その他の不正利用防止策が設けられる場合があります。
5. 運営者は、投稿内容が本規約に違反する場合、当サービスの趣旨にそぐわない場合、または安全上の懸念がある場合、投稿を不公開、修正依頼、掲載停止または削除することができます。
6. 運営者が独自に選定したWebサイトを掲載する場合は、権利関係および掲載可否を確認したうえで行います。

第4条（禁止事項）

利用者は、次の行為を行ってはなりません。

1. フィッシング、マルウェア配布、詐欺、スパムその他の危険または不正なWebサイトを投稿する行為
2. 違法な内容、成人向け内容、差別、脅迫、嫌がらせ、または他者に重大な害を与える内容を含むWebサイトを投稿する行為
3. 第三者になりすます行為、または権限がないWebサイトを本人のものとして投稿する行為
4. 第三者の著作権、商標権、プライバシー権その他の権利を侵害する行為
5. 当サービス、サーバーまたはネットワークの運営を妨害し、過度な負荷を与え、または不正にアクセスする行為
6. 投稿制限、審査または安全対策を回避しようとする行為
7. その他、運営者が合理的な理由に基づき不適切と判断する行為

第5条（安全確認と外部サイト）

1. 当サービスには、運営者または利用者が掲載した外部Webサイトへのリンクが含まれます。
2. 当サービスは、URL形式の確認、重複確認、審査、通報対応その他の安全対策を行いますが、すべての危険サイトを検出または遮断できることを保証しません。
3. 外部Webサイトの内容、安全性、正確性、合法性、可用性等は、そのサイトの運営者が責任を負うものであり、AloftPortが保証するものではありません。
4. 利用者は、リンク先のURLや表示内容を確認し、自身の判断と責任で外部サイトを利用してください。

第6条（アカウントおよび投稿への対応）

運営者は、利用者が本規約に違反した場合、不正利用または安全上の問題がある場合、必要な調査を行い、投稿の非公開・削除、機能の制限、アカウントの利用停止その他合理的に必要な措置を講じることができます。

第7条（サービスの変更、停止および終了）

運営者は、保守、障害対応、セキュリティ対策、外部サービスの停止、法令への対応その他の必要がある場合、当サービスの全部または一部を変更、停止または終了することがあります。重要な変更または終了については、可能な範囲で事前に当サービス上で告知します。

第8条（知的財産権）

当サービスの画面、ロゴ、デザイン、文章、プログラム等に関する権利は、運営者または正当な権利者に帰属します。利用者が投稿した情報の権利は、利用者または元の権利者に帰属します。

第9条（保証の否認および責任の制限）

1. 運営者は、当サービスに不具合、中断、データ消失、セキュリティ上の欠陥または権利侵害が一切ないことを保証しません。
2. 当サービスの利用または利用不能によって利用者に生じた損害について、運営者は、運営者に故意または過失がある場合を除き、責任を負いません。
3. 運営者が責任を負う場合であっても、運営者の軽過失による損害については、通常かつ直接の損害の範囲に限るものとします。ただし、消費者契約法その他の法令によりこの制限が認められない場合を除きます。
4. 利用者と外部サイト運営者または第三者との間で生じた紛争は、当事者間で解決するものとします。ただし、運営者の責任が法令上認められる場合はこの限りではありません。

第10条（規約の変更）

1. 運営者は、法令に従い、必要に応じて本規約を変更できます。
2. 利用者に重要な影響を与える変更を行う場合は、変更内容および施行日を、施行前に当サービス上で告知します。軽微な変更は、掲載時から効力を生じるものとします。

第11条（準拠法および管轄）

1. 本規約は日本法に準拠します。
2. 当サービスに関して紛争が生じた場合は、法令で別段の定めがある場合を除き、運営者の住所地を管轄する日本の裁判所を第一審の専属的合意管轄裁判所とします。
